SCJN avala embargo de Afore para garantizar la pensi\u00f3n"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Conoce los detalles de esta medida y c\u00f3mo podr\u00eda aplicarse.&nbsp;<\/h2>\n\n\n\n<p><strong>Redacci\u00f3n Informante<\/strong><\/p>\n\n\n\n<p>La Suprema Corte de Justicia de la Naci\u00f3n (SCJN) autoriz\u00f3 el embargo excepcional de fondos de las Afores a fin de garantizar el pago de&nbsp;pensiones alimenticias a menores de edad&nbsp;, esto en el caso de que el titular est\u00e9 desempleado y sin otros recursos disponibles.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfQu\u00e9 significa esta resoluci\u00f3n de la SCJN?&nbsp;<\/h3>\n\n\n\n<p>En t\u00e9rminos simples permite embargar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La subcuenta de retiro<\/li>\n\n\n\n<li>Cesant\u00eda en edad avanzada y vejez<\/li>\n<\/ul>\n\n\n\n<p>En proporci\u00f3n equivalente a lo que el trabajador podr\u00eda retirar voluntariamente por desempleo.<\/p>\n\n\n\n<p>Lo anterior para que de esta forma se pueda cubrir el monto de la pensi\u00f3n alimenticia y no se deje de cumplir con esta obligaci\u00f3n, para el caso de los usuarios que est\u00e9n en esta situaci\u00f3n.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00abJusticia familiar\u00bb<\/h3>\n\n\n\n<p>El fallo emitido por la primera sala marca un parteaguas en la justicia familiar, ya que prioriza el derecho de los menores a recibir alimentos, esto por encima de las personas que quedan en una problem\u00e1tica de desempleo.<\/p>\n\n\n\n<p>Cabe precisar que la SCJN dej\u00f3 intacto el art\u00edculo 79 de la Ley de los Sistemas de Ahorro para el Retiro (SAR) misma que proh\u00edbe los embargos sobre esa subcuenta.<\/p>\n\n\n\n<p>Por lo que quedar\u00e1 a interpretaci\u00f3n de los juzgadores el embargo de la subcuenta para cumplir con la obligaci\u00f3n de los alimentos para menores.<\/p>\n\n\n\n<p>Durante la sesi\u00f3n, se detall\u00f3 que el embargo a las Afores tambi\u00e9n estar\u00e1 topado a lo que la ley autoriza para los casos de desempleo, que es del 10 por ciento del saldo de la subcuenta de la Afore.<\/p>\n\n\n\n<p>La propuesta fue impulsada por el ministro Jorge Pardo, mismo que propuso fallar contra el art\u00edculo 79 de la Ley del SAR, que proh\u00edbe cualquier embargo sobre la subcuenta de retiro, en los casos de cesant\u00eda en edad avanzada y vejez.<\/p>\n\n\n\n<p>\u201cEl art\u00edculo 123 constitucional no se\u00f1ala que esas subcuentas sean inembargables, pues en el &#8216;Apartado A&#8217;
