Seguro Social (IMSS) publicar\u00e1 las reglas de car\u00e1cter general sobre la seguridad social para los trabajadores de aplicaciones en M\u00e9xico<\/h2>\n\n\n\n<p><strong>Redacci\u00f3n Informante<\/strong><\/p>\n\n\n\n<p>Este domingo 22 de junio entraron en vigor las modificaciones a la&nbsp;<strong>Ley Federal del Trabajo<\/strong>&nbsp;en materia de plataformas digitales, con el fin de regular el trabajo de repartidores y conductores de&nbsp;<strong>Didi, Uber o Rappi<\/strong>.<\/p>\n\n\n\n<p>En los primeros d\u00edas, las plataformas deber\u00e1n registrar a las personas trabajadoras ante el&nbsp;<strong>Instituto Mexicano de Seguro Social (IMSS),<\/strong>&nbsp;con el fin de darles seguridad social y los beneficios que ello implica, as\u00ed como la cotizaci\u00f3n para conseguir cr\u00e9ditos en el&nbsp;<strong>Instituto del Fondo Nacional de la Vivienda para los Trabajadores<\/strong>&nbsp;(Infonavit).<\/p>\n\n\n\n<p>Entre las nuevas disposiciones de la Ley Federal del Trabajo, se fijan las reglas para la participaci\u00f3n en el&nbsp;<strong>reparto de utilidades conforme al tiempo efectivamente laborado<\/strong>, mismo que no deber\u00e1 superar las 288 horas al a\u00f1o.<\/p>\n\n\n\n<p>Dicho tiempo est\u00e1 destinado para ser definido por los colaboradores, mientras que el salario ser\u00e1 fijado por tarea, servicio, obra o trabajo realizado, contemplando el proporcional del d\u00eda de descanso semanal, vacaciones, prima vacacional y aguinaldo.<\/p>\n\n\n\n<p>La Secretar\u00eda del Trabajo indic\u00f3 las fechas importantes de la reforma:<\/p>\n\n\n\n<p><strong>-27 de junio:<\/strong>&nbsp;el Instituto Mexicano del Seguro Social (IMSS) publicar\u00e1 las reglas de car\u00e1cter general sobre la seguridad social, mientras que la STPS publicar\u00e1 las reglas de car\u00e1cter general para definir el c\u00e1lculo de ingreso neto.<\/p>\n\n\n\n<p>&#8211;<strong>El primero de julio<\/strong>&nbsp;arrancar\u00e1 la prueba piloto, la cual durar\u00e1 seis meses.<\/p>\n\n\n\n<p>&#8211;<strong>24 de diciembre:<\/strong>&nbsp;el IMSS e Infonavit publicar\u00e1n las iniciativas de ley para garantizar el cumplimiento al concluir la prueba piloto.<\/p>\n\n\n\n<p>Si la persona trabajadora no recibe al menos el equivalente al salario m\u00ednimo mensual, se considerar\u00e1 trabajador independiente, sin que se presuma relaci\u00f3n laboral, pero a\u00fan as\u00ed deber\u00e1 ser afiliado al r\u00e9gimen de riesgos de trabajo del IMSS.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img alt=\"Apps Web\"\/><\/figure>\n<\/div>\n\n\n<h3 class=\"wp-block-heading\"><strong>Multas por reforma para regular aplicaciones<\/strong><\/h3>\n\n\n\n<p>La reforma establece que se impondr\u00e1n multas a personas empleadoras que utilicen plataformas digitales y no cumplan con los art\u00edculos clave de la nueva reforma:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Por no entregar contrato por escrito: sanci\u00f3n de 2,000 a 25,000 UMA (entre 217,000 y 2 millones 714,250 pesos).<\/li>\n\n\n\n<li>No emitir pol\u00edtica algor\u00edtmica: multa de 1,000 a 25,000 UMA (entre 108,570 y 2 millones 714,250 pesos).<\/li>\n\n\n\n<li>No cumplir con requisitos generales como proveer insumos, dar capacitaci\u00f3n, garantizar seguridad o registrar contratos: sanci\u00f3n de 250 a 5,000 UMA (entre 27,140 pesos y 542,850 pesos).<\/li>\n\n\n\n<li>No establecer mecanismos humanos para la revisi\u00f3n de decisiones automatizadas (cuando una persona trabajadora lo solicita): multa de 500 a 25,000 UMA (de 54,285 a 2 millones 714,250 pesos).<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-text-align-center\"
