{"id":49220,"date":"2025-05-30T09:18:47","date_gmt":"2025-05-30T15:18:47","guid":{"rendered":"https:\/\/informante.mx\/?p=49220"},"modified":"2025-05-30T09:18:51","modified_gmt":"2025-05-30T15:18:51","slug":"debo-no-niego-pago-lo-justo-como-prevenir-un-desalojo","status":"publish","type":"post","link":"https:\/\/informante.mx\/?p=49220","title":{"rendered":"Debo, no niego; Pago, lo justo | \u00bfC\u00f3mo prevenir un Desalojo?"},"content":{"rendered":"\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\">\u00bfC\u00f3mo prevenir un Desalojo?<\/h2>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\">\u00a0Teresa Carbajal<\/h2>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>A ra\u00edz de las recientes denuncias ciudadanas sobre la operaci\u00f3n de un c\u00e1rtel inmobiliario en diversos puntos del Estado, surgen dudas leg\u00edtimas, sobre m\u00faltiples casos y supuestos para evitar ser v\u00edctimas de lo mismo.<\/p>\n\n\n\n<p>Por tal motivo el presente tiene como finalidad ayudarle a distinguir y ubicar la situaci\u00f3n concreta que le derivar\u00eda en un eventual desalojo, o lanzamiento inminente de su vivienda; para que se preocupe, si le corresponde, o le ocupe si se trata de una injusticia.<\/p>\n\n\n\n<p>Los casos m\u00e1s tangibles de un desalojo, son aquellos que protagonizan los invasores de bienes inmuebles que tienen due\u00f1o, pero que permanecen sin ocupar por tratarse de grandes extensiones o porque no tienen un fin definido temporal. Ocasi\u00f3n que es aprovechada por grupos o personas para asentarse ah\u00ed de manera irregular, aspirando a no ser molestados o a convertirse en due\u00f1os por el paso del tiempo.<\/p>\n\n\n\n<p>Estos casos, derivan en lamentables eventos en donde con el auxilio de la fuerza p\u00fablica, son desocupados para restituir la posesi\u00f3n a su due\u00f1o, seguro se ha enterado por las noticias mediante im\u00e1genes, en donde menores, adultos mayores, o hasta las mascotas sufren por eventos que definitivamente, no deben ocurrir.<\/p>\n\n\n\n<p>Pues en el \u00e1nimo del deber ser, nadie que carezca de derecho, debe atentar contra la propiedad o posesi\u00f3n de un due\u00f1o, lo use o no. Reitero, en el deber ser.<\/p>\n\n\n\n<p>Situaci\u00f3n similar ocurre con los asentamientos en zonas riesgosas, como las m\u00e1rgenes de un r\u00edo, o cuando puede perderse en ellas la vida a consecuencia de un evento de la naturaleza. Y que, ante lo evidente del peligro, las autoridades proceden a la penosa desocupaci\u00f3n, en efecto, por la fuerza.<\/p>\n\n\n\n<p>Un caso tambi\u00e9n constante, es el de los due\u00f1os, con mejor derecho; en donde dos personas que ostentan un t\u00edtulo para poseer, se someten ante un tribunal, que decidir\u00e1 cu\u00e1l de los dos t\u00edtulos debe prevalecer sobre el otro. Dando desde luego las razones y los fundamentos del por qu\u00e9, si fuere temporalidad, idoneidad, certidumbre, en fin.<\/p>\n\n\n\n<p>Como en todos los casos, cuando alguien pierde (hasta en el domin\u00f3), el que pierde no queda conforme y seguro con dicha inconformidad, podr\u00eda alegar en alg\u00fan momento haber sido v\u00edctima de un fraude o injusticia, atribuyendo -al que se deje- las razones de su argumentaci\u00f3n.<\/p>\n\n\n\n<p>En estos casos, es importante, responder siempre a tiempo las demandas y ofrecer al tribunal todas las pruebas que considere necesarias para su defensa, y hasta las que considere innecesarias, re\u00fanalas y entr\u00e9guelas, porque lo que sobra nunca estorba cuando se trata de probar, \u00bfverdad Abogados?<\/p>\n\n\n\n<p>Otro, uno peculiar, que no hab\u00eda salido al tema. El del hijo a quien se le prometi\u00f3 sin documento alguno de por medio -o con uno dudoso- donar un terreno para que construyera ah\u00ed su vivienda con tal de que no abandonara a sus padres al contraer nupcias; pero que, ante un cambio de circunstancias (o humores) los padres deciden vender a un tercero. Tercero que en alg\u00fan momento reclamar\u00e1 lo que compr\u00f3, conociendo, o sin conocer, los antecedentes.<\/p>\n\n\n\n<p>De igual manera, debe someterse al tribunal que revisar\u00e1 la demanda de desocupaci\u00f3n, no la calidad de los padres, ni la moral del hijo; si no las pruebas relativas a la posesi\u00f3n, aparte de la propiedad, y a los costos de lo invertido, a fin de dar a cada quien lo que le corresponda, al momento de dirimir la controversia.<\/p>\n\n\n\n<p>El m\u00e1s com\u00fan; el de las demandas por cobranza, o deudas, que son las que concluir\u00e1n en desalojo si no se hace algo a tiempo para pagar, o para defenderse en s\u00ed. Momentos cruciales para el destino del asunto, lo ser\u00e1n las primeras diligencias, desde el llamado a juicio, las audiencias.<\/p>\n\n\n\n<p>La misma recomendaci\u00f3n, defenderse y hacerlo a tiempo. Aprenda a reconocer a un buen defensor, desde el momento en que hace el primer contacto, si le dice que no hay remedio, \u00a1\u00bfpues ya que hace Usted ah\u00ed?! Si ya sabe a d\u00f3nde lo llevar\u00e1.<\/p>\n\n\n\n<p>Los casos verdaderamente desafortunados son aquellos, en donde a alguien le roban la identidad, le falsifican firmas, le hacen firmar con enga\u00f1os, o simulan actos fraudulentos e inexistentes. Son los de nulidades absolutas. Aquellos en donde el abogado, debe ser adem\u00e1s de buen abogado, \u00a1un detective nato!<\/p>\n\n\n\n<p>Los casos para la ara\u00f1a\u2026 Estos exigen una mayor preparaci\u00f3n, para lograr demostrar a quien le asiste la raz\u00f3n.
