{"id":44772,"date":"2025-01-24T14:22:13","date_gmt":"2025-01-24T20:22:13","guid":{"rendered":"https:\/\/informante.mx\/?p=44772"},"modified":"2025-01-24T14:22:19","modified_gmt":"2025-01-24T20:22:19","slug":"aprueba-congreso-ley-sobre-solucion-de-controversias","status":"publish","type":"post","link":"https:\/\/informante.mx\/?p=44772","title":{"rendered":"Aprueba Congreso ley sobre soluci\u00f3n de controversias"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Se busca asegurar m\u00e9todos alternativos que privilegien la paz social, la restauraci\u00f3n del tejido social y la soluci\u00f3n expedita de controversias<\/h2>\n\n\n\n<p><strong>Redacci\u00f3n Informante<\/strong><\/p>\n\n\n\n<p><strong>Xalapa, Ver., 23 de enero de 2025.-<\/strong> Con 38 votos a favor, cero en contra y sin abstenciones, este Congreso aprob\u00f3 Dictamen con Proyecto de Ley de Mecanismos Alternativos de Soluci\u00f3n de Controversias del Estado de Veracruz, presentado por la Comisi\u00f3n Permanente de Justicia y Puntos Constitucionales y derivado de la iniciativa remitida a esta Soberan\u00eda por la gobernadora de Veracruz, Norma Roc\u00edo Nahle Garc\u00eda.<\/p>\n\n\n\n<p>De acuerdo con la comisi\u00f3n dictaminadora, dicho ordenamiento est\u00e1 dise\u00f1ado para abordar de manera espec\u00edfica los procedimientos y lineamientos relacionados con la soluci\u00f3n de controversias mediante m\u00e9todos distintos al proceso jurisdiccional. De acuerdo con esto, los mecanismos alternativos administrativos deben quedar como competencia del Tribunal de Justicia Administrativa del Estado de Veracruz (Trijaev).<\/p>\n\n\n\n<p>Tambi\u00e9n, que respecto a las disposiciones relacionadas con la certificaci\u00f3n y registro de personas facilitadoras, se fortalecieron los requisitos establecidos en los art\u00edculos correspondientes para garantizar est\u00e1ndares elevados de profesionalizaci\u00f3n, en particular, se enfatiza la obligaci\u00f3n de la actualizaci\u00f3n continua y el cumplimiento con los lineamientos nacionales, lo cual contribuye a la homologaci\u00f3n con la Ley General de Mecanismos Alternativos de Soluci\u00f3n de Controversia.<\/p>\n\n\n\n<p>Adem\u00e1s, se precisan disposiciones transitorias para brindar certeza y asegurar una transici\u00f3n ordenada entre el actual Centro de Justicia Administrativa (Cejav) y el nuevo Centro P\u00fablico de Mecanismos de Soluci\u00f3n de Controversias, incluyendo la transferencia de recursos humanos, materiales, financieros, con pleno respeto a los derechos laborales de las y los trabajadores.<\/p>\n\n\n\n<p>En cuanto a los procesos restaurativos y terap\u00e9uticos, se ampliaron las definiciones y los alcances para incorporar un enfoque integral que fomente el bienestar emocional y psicol\u00f3gico de las partes involucradas en los conflictos, particularmente en atenci\u00f3n y observancia de las necesidades de ni\u00f1as, ni\u00f1os y adolescentes y de los grupos vulnerables, para fortalecer la humanizaci\u00f3n de la justicia alternativa.<\/p>\n\n\n\n<p>La comisi\u00f3n precisa que las modificaciones realizadas al proyecto propuesto se realizan para fortalecer su alcance y eficacia, cumpliendo con los objetivos planteados desde su exposici\u00f3n de motivos y garantizando un acceso efectivo a la justicia mediante m\u00e9todos alternativos que privilegien la paz social, la restauraci\u00f3n del tejido social y la soluci\u00f3n expedita de controversias, aline\u00e1ndose con los Objetivos de Desarrollo Sostenible de la Agenda 2030, particularmente el Objetivo 16, \u201cPaz, Justicia e Instituciones S\u00f3lidas\u201d, al promover instituciones accesibles, inclusivas y eficaces que brinden soluciones oportunas a los conflictos que reduzcan las desigualdades en el acceso a la
