{"id":40646,"date":"2024-10-07T17:52:11","date_gmt":"2024-10-07T23:52:11","guid":{"rendered":"https:\/\/informante.mx\/?p=40646"},"modified":"2024-10-07T17:52:19","modified_gmt":"2024-10-07T23:52:19","slug":"modifica-congreso-de-veracruz-el-articulo-145-del-codigo-civil","status":"publish","type":"post","link":"https:\/\/informante.mx\/?p=40646","title":{"rendered":"Modifica Congreso de Veracruz el Art\u00edculo 145 del C\u00f3digo Civil"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">\u2022 Cumple Congreso con lo ordenado por la SCJN y, tras el procedimiento de consulta a grupos de personas con discapacidad, determina nueva redacci\u00f3n al ordenamiento.<\/h2>\n\n\n\n<p><strong>Redacci\u00f3n Informante<\/strong><\/p>\n\n\n\n<p>El Pleno de la LXVI Legislatura aprob\u00f3 el dictamen de la Comisi\u00f3n Permanente de Justicia y Puntos Constitucionales que reforma el p\u00e1rrafo s\u00e9ptimo y adiciona un p\u00e1rrafo, que ser\u00e1 el octavo, con el corrimiento del actual octavo a noveno, del Art\u00edculo 145 del C\u00f3digo Civil de la entidad, para precisar las medidas a seguir sobre los casos de divorcio y que involucre a personas mayores con discapacidad, que est\u00e9n bajo tutela de exc\u00f3nyuges, y con la finalidad de asegurarles su protecci\u00f3n, en estricto apego a derechos humanos.<\/p>\n\n\n\n<p>De acuerdo con el dictamen, aprobado con 40 votos a favor, sin abstenciones ni votos en contra, la nueva redacci\u00f3n de dicho art\u00edculo es la siguiente: \u201cpara el caso de personas mayores con discapacidad, que a\u00fan se encuentren bajo tutela de exc\u00f3nyuges, en la sentencia de divorcio deber\u00e1n establecerse las medidas correspondientes para su protecci\u00f3n, de conformidad con la legislaci\u00f3n vigente, y en estricto apego al ejercicio de sus derechos humanos.<\/p>\n\n\n\n<p>\u201cLa sentencia de divorcio deber\u00e1 establecer la reparaci\u00f3n del da\u00f1o en caso de violencia familiar contra cualquiera de las personas integrantes de la familia. El \u00f3rgano jurisdiccional resolver\u00e1 sobre la compensaci\u00f3n de bienes a que haya lugar que prev\u00e9 el art\u00edculo 142 fracci\u00f3n VI, atendiendo a las circunstancias especiales de cada caso\u201d.<\/p>\n\n\n\n<p>De esta manera, la LXVI Legislatura del estado de Veracruz da cumplimiento a la sentencia, dictada en la Acci\u00f3n de Inconstitucionalidad 144\/2020 y su acumulada 185\/2020, de la Suprema Corte de Justicia de la Naci\u00f3n (SCJN).<\/p>\n\n\n\n<p>Como parte de las acciones para este cumplimiento, el Congreso del Estado, por conducto de la Comisi\u00f3n Permanente de Derechos Humanos y Atenci\u00f3n a Grupos Vulnerables, celebr\u00f3 el 25 de junio de 2024 el foro consultivo con personas con discapacidades auditiva, motriz, visual o psicosocial, entre otras, con la finalidad de escuchar sus opiniones y aportaciones. Como parte de estos compromisos, se cre\u00f3 un Comit\u00e9 de Seguimiento, integrado por cinco personas.<\/p>\n\n\n\n<p>El 23 de julio de este a\u00f1o, la misma comisi\u00f3n legislativa present\u00f3 al Pleno la Iniciativa con Proyecto de Decreto con la modificaci\u00f3n al Art\u00edculo 145 del C\u00f3digo Civil. La propuesta fue turnada para su an\u00e1lisis a la Comisi\u00f3n Permanente de Justicia y Puntos Constitucionales.<\/p>\n\n\n\n<p>El pasado 2 de octubre, el diputado Luis Fernando Cervantes Cruz y la diputada Rosalinda Galindo Silva, presidente y vocal respectivamente de la Comisi\u00f3n Permanente de Justicia y Puntos Constitucionales, se reunieron con el Comit\u00e9 de Seguimiento y en este acto acordaron el Dictamen con los cambios a la legislaci\u00f3n local.<\/p>\n\n\n\n<p>En la sesi\u00f3n extraordinaria y por acuerdo de la Junta de Coordinaci\u00f3n Pol\u00edtica y la comisi\u00f3n dictaminadora, se dio el uso de la voz a las ciudadanas Luc\u00eda Borj\u00f3n L\u00f3pez Coterilla e Isabel Oyuqui Nieto Z\u00e1rate, integrantes del Comit\u00e9 de Seguimiento, quienes expresaron en la tribuna sus consideraciones sobre el proceso legislativo de esta reforma.<\/p>\n\n\n\n<p>Posteriormente, la Presidencia de la Mesa Directiva dio el uso de la voz a las y los representantes de los grupos legislativos para expresar sus posicionamientos.<\/p>\n\n\n\n<p>Por el Grupo Legislativo de Morena, el diputade Ky Dur\u00e1n Chincoya anunci\u00f3 el voto a favor de la reforma y subray\u00f3 que, m\u00e1s que cumplir con el mandato proveniente de la SCJN, act\u00faan con el elevado esp\u00edritu democr\u00e1tico y en congruencia con sus valores y principios, pues \u201csabemos lo que representa para las personas con discapacidad abrirse paso ante las barreras que les impiden alcanzar una verdadera inclusi\u00f3n social\u201d.<\/p>\n\n\n\n<p>Agreg\u00f3 que, \u201ces necesario exigir el derrumbe de muros y edificar puentes que les concedan un mejor nivel de vida, como ya sucede con derechos constitucionalmente adquiridos y que les permiten recibir apoyos econ\u00f3micos con dignidad y no como una d\u00e1diva\u201d.<\/p>\n\n\n\n<p>Por la bancada del Partido Acci\u00f3n Nacional (PAN), la diputada Itzel Yescas Valdivia expres\u00f3 su respaldo al dictamen, toda vez que, dijo, la reforma es producto de la consulta realizada a las personas con discapacidad y agreg\u00f3: \u201cEsperamos que el esfuerzo en la realizaci\u00f3n de los foros sea suficiente para superar el criterio de la Corte y que la normativa constituya un instrumento efectivo para garantizarles sus derechos\u201d.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p
