{"id":40625,"date":"2024-10-07T17:01:10","date_gmt":"2024-10-07T23:01:10","guid":{"rendered":"https:\/\/informante.mx\/?p=40625"},"modified":"2024-10-07T17:01:19","modified_gmt":"2024-10-07T23:01:19","slug":"plantea-diputado-tipificar-el-delito-de-transfeminicidio","status":"publish","type":"post","link":"https:\/\/informante.mx\/?p=40625","title":{"rendered":"Plantea Diputado tipificar el delito de transfeminicidio"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">\u2022 Quien lo cometa podr\u00eda ser acreedor a una pena de 40 a 70 a\u00f1os de prisi\u00f3n, de acuerdo con la propuesta de Ram\u00f3n D\u00edaz.<\/h2>\n\n\n\n<p><strong>Redacci\u00f3n Informante<\/strong><\/p>\n\n\n\n<p>El legislador Ram\u00f3n D\u00edaz \u00c1vila propuso a la Diputaci\u00f3n Permanente del Congreso de Veracruz la iniciativa con proyecto de decreto que reforma diversas disposiciones del C\u00f3digo Penal para crear el delito de transfeminicidio y sancionar con penas de 40 a 70 a\u00f1os de prisi\u00f3n a quien, por raz\u00f3n de identidad o expresi\u00f3n de g\u00e9nero, prive de la vida a una mujer trans o a una persona cuya identidad o expresi\u00f3n de g\u00e9nero, real o percibida, se encuentre dentro del espectro de g\u00e9nero femenino.<\/p>\n\n\n\n<p>El legislador del Partido del Trabajo (PT) subray\u00f3 que el transfeminicidio fue reconocido por la Comisi\u00f3n de Derechos Humanos de la Ciudad de M\u00e9xico como el primero en el pa\u00eds, a ra\u00edz del asesinato de Paola Buenrostro, en 2016, que suscit\u00f3 una Iniciativa para tipificar el delito de transfeminicidio, lo que se logr\u00f3 concretar con su incorporaci\u00f3n en febrero de 2024 en el C\u00f3digo Penal del Estado de Nayarit, la primera entidad en establecerlo.<\/p>\n\n\n\n<p>Agreg\u00f3 que la Comisi\u00f3n Nacional de Derechos Humanos (CNDH) exhort\u00f3 y recomend\u00f3 en marzo de este a\u00f1o, legislar y normar en las entidades federativas sobre materia trans, proponiendo que establezca en los c\u00f3digos penales el transfeminicidio. Actualmente solo dos entidades han legislado al respecto.<\/p>\n\n\n\n<p>El diputado Ram\u00f3n D\u00edaz precis\u00f3 que, de acuerdo con datos de la organizaci\u00f3n Transgender Europe, de 2008 a 2023, M\u00e9xico ocup\u00f3 el segundo lugar mundial en transfeminicidios con 701 casos, solo superado por Brasil, con mil 841.<\/p>\n\n\n\n<p>Asimismo, expuso que con informaci\u00f3n de colectivos y organizaciones LGBTTTIQ+, en M\u00e9xico existen aproximadamente 908 mil personas con identidad de g\u00e9nero trans, quienes en su mayor\u00eda sufren diversos ataques, discriminaci\u00f3n y vulnerabilidad.<\/p>\n\n\n\n<p>Destac\u00f3 que el Centro de Apoyo a la Identidades Trans (CAIT), que se dedica a documentar los asesinatos de las personas trans, se\u00f1ala que las entidades que se mantienen con el mayor n\u00famero de incidencias en los a\u00f1os de 2008 a 2023 son: Veracruz con 80 casos; Guerrero con 60, Estado de M\u00e9xico con 57 y Ciudad de M\u00e9xico con 43.<\/p>\n\n\n\n<p>Por \u00faltimo, dijo que al Poder Legislativo le corresponde normar la protecci\u00f3n de los derechos ciudadanos. \u201cEscuchar la voz de todas y todos es nuestro deber y como legisladores debemos actuar por dignificar el papel de la ciudadan\u00eda y principalmente de aquellos grupos que son excluidos por gran parte de la sociedad\u201d, concluy\u00f3.<\/p>\n\n\n\n<p>La iniciativa que reforma y adiciona el Cap\u00edtulo VII Quater del T\u00edtulo XXI, as\u00ed como el art\u00edculo 367 Quater del C\u00f3digo Penal del estado, fue turnada para su estudio y dictamen a la Comisi\u00f3n Permanente de Justicia y Puntos Constitucionales. Se adhirieron la diputada Ruth Callejas Rold\u00e1n y el diputado Miguel David Hermida Copado.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p
