Te depositaron un cr\u00e9dito que no pediste, o ya no deseas un cr\u00e9dito que s\u00ed tramitaste, y el acreditante te niega el derecho de cancelar el contrato; sin duda esto te interesa.<\/p>\n\n\n\n

Le ha pasado que, as\u00ed como las molestas llamadas de cobranza cuando no pasan ni veinticuatro horas de la fecha en que se vence el pago de un cr\u00e9dito, o peor a\u00fan aquellas en donde le llaman un d\u00eda antes para recordarle que no se le olvide pagar, lo que a\u00fan no ha vencido; le bombardean tambi\u00e9n con el ofrecimiento de pr\u00e9stamos que no necesita.<\/p>\n\n\n\n

Desde que llega a la ventanilla del banco en donde hasta le echan porras por ser un cliente cumplido o tener una peque\u00f1a cuenta de ahorros, y que por tales motivos, como premio a ese buen comportamiento le han pre autorizado un cr\u00e9dito.<\/p>\n\n\n\n

No hablemos de los ofrecimientos de cr\u00e9ditos que se encuentran en las oficinas p\u00fablicas, en donde como jubilado, pensionado, usuario o derechohabiente ya le esperan con la cl\u00e1sica tarjetita de presentaci\u00f3n para hacerle la promoci\u00f3n.<\/p>\n\n\n\n

Bueno, o que por error le dio aceptar en el cajero al bot\u00f3n equivocado, o que le aparece un dep\u00f3sito en su cuenta bancaria que no ten\u00eda considerado y al realizar las investigaciones se trata de un pr\u00e9stamo que no desea.<\/p>\n\n\n\n

Otro supuesto es, que s\u00ed haya tramitado el pr\u00e9stamo con la sofom, pero que al reconsiderarlo y ver todo lo que tendr\u00e1 que pagar por tan poquito dinero, hace cuentas y decide mejor cancelar el trato y devolver el dinero.<\/p>\n\n\n\n

Si le ha pasado; seguramente tambi\u00e9n le ha pasado que al ir a la instituci\u00f3n acreditante se hacen los que no saben, y le dicen que no tiene de otra mas que pagarlo en la forma que lo dicta el contrato de adhesi\u00f3n o sea a mensualidades.<\/p>\n\n\n\n

Una pesadilla, pensar que cada mes tendr\u00e1 que pagar intereses y todo por la mala orientaci\u00f3n y renuencia de quienes saben siempre que un cr\u00e9dito puede cancelarse siempre y cuando no se haya dispuesto de los fondos, esto \u00faltimo tambi\u00e9n es importante.<\/p>\n\n\n\n

Pero primero, mire, el art\u00edculo 11 Bis-1, de la Ley para la Transparencia y Ordenamiento de los Servicios Financieros as\u00ed como las Disposiciones de Car\u00e1cter General en materia de transparencia aplicables a las Sociedades Financieras de Objeto M\u00faltiple, Entidades No Reguladas, tienen la respuesta.<\/p>\n\n\n\n

Pues disponen de manera clara y terminante que los clientes contar\u00e1n con un per\u00edodo de gracia de diez d\u00edas h\u00e1biles posteriores a la firma de un contrato de adhesi\u00f3n para cancelarlo -es decir- un cr\u00e9dito aun habi\u00e9ndolo solicitado y firmado de conformidad para recibirlo, puede cancelarse.<\/p>\n\n\n\n

En tal caso, la entidad acreditante no podr\u00e1 cobrar comisi\u00f3n alguna, se entiende que sin aplicar penalidad alguna tampoco, pues no lo estipula la ley. Esto a condici\u00f3n del cumplimiento de dos premisas, la primera que se haga dentro del plazo de los diez d\u00edas, y la segunda siempre y cuando no se hayan dispuesto los fondos depositados.<\/p>\n\n\n\n

Esto es una medida de protecci\u00f3n para el p\u00fablico usuario, es decir los clientes, pues claro est\u00e1, la publicidad enga\u00f1osa que tiene las entidades financieras sobre sus productos que en muchas ocasiones no cumplen con lo que prometen, y la que no se advierte hasta que se reflexiona al tomar cuidado (al otro d\u00eda de la firma) y leer lo que firmaron, observando hasta entonces la diferencia entre lo que se recibe y lo que se tiene que pagar.<\/p>\n\n\n\n

Tambi\u00e9n para frenar la voracidad en la colocaci\u00f3n desmedida de cr\u00e9ditos, casos en donde hasta sin desearlo recibes el dinero, pero con la consigna de pagarlo a tasas usureras.<\/p>\n\n\n\n

As\u00ed, es un hecho, puedes devolverlo sin ning\u00fan tipo de sanci\u00f3n, presentando por escrito tu solicitud ante el acreditante, si te niegan el derecho hay un procedimiento administrativo previo a la interposici\u00f3n de un proceso judicial que es de naturaleza administrativa ante la Condusef y gratuito.<\/p>\n\n\n\n

Inicia ya la \u00e9poca del bombardeo de ofertas crediticias, y vale mas estar prevenido frente a un pr\u00f3ximo a\u00f1o dos mil veinticuatro en el que el panorama econ\u00f3mico no parece ser alentador, y es mejor evitar la toma de compromisos de dif\u00edcil cumplimiento.<\/p>\n\n\n\n
